Terms and Conditions

These terms apply to all services provided by Beau Agency to any client, regardless of the service type or the duration of the engagement. They apply to one-time projects and ongoing retainers alike.

An engagement begins when both parties have agreed in writing to the scope of work and the client has paid the required deposit. Agreement in writing includes confirmation by email.

Every engagement begins with a written agreement confirming the services selected, the scope of work, and the price. No work begins before this agreement is confirmed and the deposit is received.

The client is responsible for providing all required materials, documents, and information on time and in full. Delays caused by incomplete or late submissions from the client may affect turnaround times. Beau Agency is not responsible for delays resulting from the client's failure to provide materials as requested.

The quality of every output depends directly on the quality and accuracy of the information the client provides. Beau Agency produces work based on what the client supplies. Inaccurate or incomplete submissions are the responsibility of the client.

All outputs are delivered digitally. Turnaround times are communicated at the start of each engagement and begin from the date all required materials have been received in full.

Each service includes one round of revisions. Revisions must be submitted within fourteen days of delivery. Revisions are accepted on the basis of factual corrections or information that was not included in the original brief.

Changes in creative direction, tone, or scope after delivery are treated as a new brief and quoted separately. Beau Agency reserves the right to decline revision requests that fall outside the agreed scope.

One-time services require a deposit of fifty percent before work begins. The remaining fifty percent is due upon delivery. No work begins without the deposit confirmed.

Monthly retainers are invoiced at the start of each month and must be paid before that month's work begins. No work is produced for the following month until payment is received.

Assessment scoring services require full payment before scoring begins.

All payments are made by bank transfer to the account details provided in the invoice. Invoices are payable within seven days of issue.

Late payment may result in a suspension of work until the outstanding balance is settled. Beau Agency reserves the right to charge interest on overdue invoices in accordance with applicable French law.

Upon receipt of full payment, the client owns all deliverables produced for them by Beau Agency as part of the agreed engagement. This includes all written content, documents, reports, and training materials.

Beau Agency retains ownership of all internal systems, methodologies, processes, and tools used to produce deliverables. These are proprietary to Beau Agency and are not transferred to the client under any circumstances.

The client grants Beau Agency the right to use materials submitted for the purpose of producing the agreed deliverables. This right is limited to the duration of the engagement and does not extend beyond it.

Beau Agency treats all client materials, brand information, product data, commercial information, and any other content shared during an engagement as strictly confidential.

Client information is never shared with third parties, never repurposed for other clients, and never used for any purpose outside the agreed engagement.

This obligation of confidentiality applies without time limit and survives the end of the engagement.

All data shared with Beau Agency is processed exclusively through the Anthropic API. Client data is never used to train AI models and is automatically deleted from Anthropic servers within seven days of processing. Beau Agency does not retain copies of raw client data beyond what is operationally necessary for the delivery of the agreed service.

Beau Agency operates as a data processor under the General Data Protection Regulation (GDPR) and applicable French data protection law. All engagements involving personal data are conducted in accordance with these obligations.

Where an engagement involves the processing of personal data on behalf of the client, a Data Processing Addendum is provided and must be signed before work begins.

Beau Agency is not liable for any indirect, consequential, or incidental loss arising from the use of its deliverables, including but not limited to loss of revenue, loss of business, or reputational damage.

Beau Agency's total liability to the client under any engagement is limited to the fees paid by the client for the specific service that gave rise to the claim.

Beau Agency is not responsible for the accuracy of information provided by the client and used as the basis for deliverables. The client is responsible for reviewing all outputs before publication or use.

Either party may terminate an engagement by written notice. Where work has already begun, the client remains liable for the full cost of work completed to the date of termination. Deposits are non-refundable once work has begun.

Beau Agency reserves the right to terminate an engagement immediately and without liability if the client fails to meet payment obligations, provides materially false or misleading information, or acts in a manner that is harmful to Beau Agency or third parties.

These terms are governed by the laws of France. Any dispute arising from or in connection with these terms or any engagement shall be subject to the exclusive jurisdiction of the courts of Paris.
